Ethics
BoatBoys ethics provide principles and the behaviour that the BoatBoys Community reasonably expects of service providers and service users participating in promoting a service, individual profile or company profile.
Terminology:
‘service user’ the individual or company concerned that is hiring labour or a service from another member on the BoatBoys website.
‘service provider’ the individual or company concerned that is selling labour or a service that is listed on the BoatBoys website.
‘corporate service provider/user,’ a limited liability company, enterprise or sole trader.
‘BoatBoy’ is an employee of BoatBoys Limited.
Ten Principals of BoatBoys Community:
BoatBoys community expect service providers and service users to always:
1. Use good faith and honesty at all times.
2. Comply with and abide by all laws of New Zealand.
3. Abide by BoatBoys Terms and Conditions.
4. Always use BoatBoys service on the basis of trust and good will.
5. Give accurate and true membership and personal profile information.
6. Never give personal phone numbers or addresses through the BoatBoys site.
7. Always complete transactions in a professional manner.
8. When a time is agreed on, both parties give their word to be punctual.
9. Your Yes is Yes and your No is No at BoatBoys.
10. Have fun!
Service users agree to always:
• Respond to emails as soon as possible.
• Before negative feedback is placed, discuss the issue concerned and try to work out a positive outcome for both or all parties involved.
• Place helpful feedback with a job description on quality and timing of work performed by the service provider to benefit other service users.
• Provide all consumables and materials for the booking you have made through BoatBoys.
• Treat the person/people you hire with dignity and respect at all times.
• Be as clear as possible to the best of your knowledge with the job description you set for the person/people you hire.
Service providers agree to always:
• Describe their services, qualifications and experience accurately.
• Reply to emails and questions as soon as possible.
• Charge an hourly rate that is fair and reasonable to the current market place rates.
• Before negative feedback is placed, discuss the concerned issue and try to work out a positive outcome for both or all parties involved.
• Avoid a revengeful negative feedback response.
• Place helpful feedback regarding the character of the service user.
• Provide tools for the job intended, and ensure your tool list on your profile is accurate.
• Never provide materials or consumables for the service you have been booked to complete. It is solely the responsibility of the service user to provide all materials and consumables.
• Never at any time will the service provider exchange details and complete work outside of BoatBoys. Remember you are risking termination of membership/Employment for both parties and reimbursement/legal costs for the service user.
Corporate service users/providers always agree to:
• Comply with all relevant laws, including the Fair Trading Act 1986 and its regulations and the Consumer Guarantees Act 1993.
• Provide services that are of a high professional manner and warn service users of any potential dangers, quality issues and improved methods and or procedures of achieving same result in order to limit the amount of time spent on providing the service you provide.
• Act responsibly and promptly to fix any service that is not of high workmanship. This must be done within a reasonable time after booking is completed and agreed on by both parties concerned.
Conduct of Users: You will not post or transmit any software, data, cv content, information, pictures, graphics and other material on the Website that:
• is or is reasonably likely to be defamatory, obscene, upsetting, offensive, or that we may advise from time to time that we reasonably consider to be in any way objectionable;
• is or is reasonably likely to be unsuitable for persons under the age of 18 years;
• infringes the intellectual property rights of any person or company;
• you know or suspect to be false or misleading information;
• contains any virus or other destructive component;
• is prohibited by or violates any applicable law or breaches the Terms and Conditions
You will not do any of the following (either directly or indirectly) while using the Website:
• defame, abuse, harass, stalk, threaten, breach the confidence or violate the legal rights of others;
• impersonate any other person or company;
• breach any applicable law or regulation;
• commit or encourage a criminal offence.
• disrupt an exchange of information between users or otherwise act in a manner that negatively affects other users and the BoatBoys website;
• transmit any unsolicited advertising, promotional materials or any other forms of solicitation, unless expressly authorised by us;
• hack into any part of the Website;
• You waive all claims against us in respect of or arising from any reliance by us upon any use of your password. BoatBoys retain the right to disclose information relating to your registration and/or affairs with us and other users as they see fit.
• As the service user / provider in a transaction you agree that we may disclose your email address to the other party in that transaction. You also agree that we may disclose your telephone number to other users where you have ticked the relevant box allowing BoatBoys to do so.
Company Intelectual property protection: You agree as a service provider working for a Company you will not copy or use I.P for any use other than what the service user that hires you for. All Intellectual property remains the property of the service user at all times and procedures learnt will not be transferred to other companies in written or oral form.
Boatboys community: We need to protect the BoatBoys community from crafty intent by a minority of users. If you have concerns with regard to member acting outside of the terms & conditions and ethics of Boatboys please contact us . This is a part of the BoatBoys ethics to protect all involved so we can keep this service available for our marine community to benefit from. If we stick together we will have strength so it is part of the ethics for this reason. Unity.
Site Usage Policy: This Site Usage Policy hereby incorporates by reference all terms, conditions rules, policies and guidelines on the Site, including the BoatBoys Terms & Conditions .
Communication: BoatBoys encourages detailed and professional communication between Service users and Providers through the Site. You are required to log onto the Site to manage Jobs and maintain an electronic record of all written communication.
Conversations between the Service user and the Provider are to remain open and not used for the purpose of bypassing BoatBoys. If there is a dispute it is to remain between the service user and Service provider. BoatBoys provides a designated space in the Provider profile to enter email address, telephone numbers and other personal details. Providers must not enter contact information or solicit private communications in public messages, in Job descriptions or applications, or sections of their BoatBoys profile outside of the designated Contact Information fields including the upload of the CV and pictures.
Posting information and Content: You agree to provide true, accurate and complete information whenever you post any information or content on the Site (including but not limited to posting a request for Provider Services, providing a proposal for a posted Job, posting your profile and providing feedback). You agree to update such information as it changes and agree to use good judgment when posting information, remarks or other content regarding other Users, Members, Clients, Providers, BoatBoys or any other third party. You understand that you will be held legally responsible for damages suffered by other Users, Members, Clients, Providers, BoatBoys or any third party as a result of legally actionable or defamatory comments, remarks or other information or content which you post to the BoatBoys Site.
Posting Hot Jobs: As a Service user, when posting a Hot Job and hiring Service Providers, you agree to the following guidelines:
• Post Jobs with clear scope and accurate location. Do not hesitate to contact us for assistance with posting a Job.
• Once you have hired for your Job, log onto the Site to manage the Job. Ensure the job is not listed one the job is either finished or confirmed.
• Not to post fake jobs.
Prohibited Hot Job postings: You agree NOT to do the following when you post a Hot Job or transmit information on the Site:
• Post any Job, submit any proposal that is against the laws of New Zealand.
• Post any Jobs that are fake, posted without the intention to hire or complete the Job, or posted only to receive pricing information.
• Post any Jobs that offer commission or equity compensation.
• Post any Jobs that request free services.
• Post any Job, proposal, deliverable or transmit any content that infringes a third party's intellectual property rights, license rights, the terms and conditions of use of such third party's Web site or copyrighted materials or such third party's rights of publicity or privacy.
• Post any Job, proposal, or deliverable or transmit any content related to or containing any adult or sexually explicit material including the use of potentially offensive language.
• Post Jobs related to bulk email or spam
• Post any Job, submit any proposal that violates, or has the potential to violate, the integrity of academic and professional applications of other people or Companies.
Prohibited site activities: You agree NOT to do any of the following on the Site:
• Post false or misleading information about a product, service or service request.
• · Post logos, seals or slogans from third parties on the BoatBoys site.
• Post or transmit any content that is profane, vulgar, racist, offensive, threatening, harmful, abusive, defamatory or disparaging.
• Post or transmit unprofessional or offensive comments about a User, Member, Provider, Client, BoatBoys, or any third party.
• Suggest or solicit another User to contact you directly in order to buy or sell services outside of BoatBoys.
• Access, tamper with or use non-public or non-authorized areas of the BoatBoys Site. Unauthorized individuals attempting to access these areas of the Site will be subject to prosecution.
• Tamper with postings of other Users, Members or BoatBoys.
• Do anything that would create or impose an unreasonable or disproportionately large burden or load on the Site.
• Frame or link to the Site except as permitted in writing by BoatBoys.
• · Impersonate or misrepresent your affiliation with any person or entity
• Fail to respond to an email from BoatBoys regarding violation, employment issues, dispute or a complaint within two business days.
• Take any action that may undermine the feedback or ratings systems (such as importing or exporting feedback information off the Site, or using feedback as an extortion mechanism).
• Select a Service user or hire a Provider on the basis of religion, sex or race.
Registering to Provide Services: If you wish to provide services through BoatBoys as a contractor or employee, you must complete the Join Now process then get approved by BoatBoys. You agree to provide true, accurate, complete information and to update such information to maintain its truthfulness, accuracy and completeness. For purposes of your BoatBoys registration information, your true, accurate, complete location is the primary place from which your Provider Services are rendered. BoatBoys will suspend or terminate your Account upon the discovery that any information you provided or posted is not true, accurate or complete, or as a result of other violations of the BaotBoys Terms and Conditions.
Job Fulfillment Guidelines: You agree to the following Job fulfillment guidelines:
• Once you have been hired for a Job, log onto the Site to manage the Job and its history.
• Inform the Client and BoatBoys management if you will be unavailable for more than one business day.
• If you are unable to complete the Job, alert BoatBoys immediately.
Rating and the feedback system: Always leave objective balanced feedback about the Users with whom you have hired. You acknowledge and agree that the Site contains public feedback from Users with whom you have transacted. You acknowledge that feedback results for you may consist of comments and ratings left by other Users and that BoatBoys may calculate a composite feedback number based on these individual ratings. Providers and users agree to be rated by Clients along several criteria.
BoatBoys do not monitor or censor these opinions or investigate any remarks posted by Users and Providers for accuracy or reliability unless a member brings the posting to our attention. You may be held legally responsible for damages suffered by other Users or third parties as a result of your remarks if a court finds that your remarks are legally actionable or defamatory. You agree to report violations or abuses of our rating and feedback system immediately.
· Feedback solicitation such as offering to sell or buy services is not permitted.
· Language that is profane, vulgar, or racist or contains adult material. Insulting or inflammatory
feedback is strongly discouraged but will not always be removed.
